It is well known that article 4.8 of the 249/97 law, which forms the legal basis for this decision, cannot be applied to this particular case.
Therefore Telecom Italia and Seat Pagine Gialle intend to appeal the decision immediately to the Tar of Lazio (Regional Administrative Court) and proceed with the implementation of the business plan regarding TMC under the terms foreseen, subject to Antitrust approval.
